The Bombay High Court has granted bail to a man from Maharashtra who was arrested on charges of raping a 13-year-old girl. The court stated that their relationship was based on love rather than lust.

Justice Urmila Joshi-Phalke noted that although the girl was a minor, she had informed the police that she willingly left her home and chose to stay with the accused, Nitin Dhaberao. Taking this into consideration, the court granted bail, emphasizing that Dhaberao himself was only 26 years old.

“The applicant is also a young individual at the age of 26, and their relationship is based on love,” Justice Joshi-Phalke stated in her order.

The court further added, “It appears that the alleged sexual relationship between the two individuals is a result of mutual attraction and not a case where the applicant forced the victim into a sexual assault driven by lust.”

In August 2020, the girl’s father had filed a missing person report. When the police located her, she informed them that she had willingly left her home due to her relationship with Dhaberao. She even claimed that he had promised to marry her, which led her to steal valuables and money from her house before going to stay with him.
