A Bharatiya Janata Party (BJP) MLA from Uttar Pradesh has been sentenced to 25 years in jail and may face disqualification from the Assembly after being found guilty of raping a minor. The incident occurred in 2014, and the survivor’s brother claims that the MLA had exerted pressure and threatened the family for over a year following the filing of the complaint.
Ramdulare Gond, a tribal MLA representing the Duddhi Assembly constituency in Sonbhadra district, was convicted and fined Rs 10 lakh by an MP-MLA court on Friday. Gond’s wife was the head of a village panchayat in the Duddhi constituency at the time of the crime, and Gond, who held local influence, committed the rape in an attempt to further his political ambitions. The complaint was registered at the Myorpur police station.
Gond won the Assembly election on a BJP ticket last year, and his case was transferred to the MP-MLA court in Sonbhadra, where he was pronounced guilty on Tuesday. The public prosecutor stated that Gond was convicted under the Protection of Children from Sexual Offences Act, as well as sections related to rape and destruction of evidence in the Indian Penal Code.
The MLA has been sentenced to 25 years of rigorous imprisonment and ordered to pay a fine of Rs 10 lakh, which will be given to the survivor, according to Ahsan Ullah Khan, the additional district and sessions judge of the MP-MLA court.
The survivor’s family expressed relief at the verdict, stating that it took them a considerable amount of time to obtain justice. They also revealed that Ramdulare Gond had threatened them for a year in an attempt to coerce them into withdrawing the case.
As a result of the conviction, Gond will be disqualified from the Uttar Pradesh Assembly. Although this will not impact the BJP’s numerical strength, as they hold 254 out of 403 seats in the house, it may leave the party vulnerable to criticism from the opposition.
Under the Representation of the People Act, a lawmaker who has been sentenced to imprisonment for two years or more will be disqualified “from the date of such conviction” and remain disqualified for six years after completing the sentence.
